These Terms & Conditions (“Terms”) govern your access to and use of the auto4you website at https://auto4you.in, the auto4you application at https://app.auto4you.in, and all related products, dashboards, APIs and services (together, the “Platform” or the “Service”).
This website is operated by auto4you. auto4you is the brand and trade name of Hardik Agarwal, a sole proprietor (individual) based in India, with registered/business address at Rajasthan Agro Agencies, Shyam Colony, Shahpura, Jaipur, Rajasthan – 303103 (PAN-registered sole proprietorship; not currently registered under GST) (referred to as “auto4you”, “we”, “us” or “our”). The terms “you”, “your”, “Customer” and “Subscriber” refer to the business entity that registers for, accesses or uses the Service.
By creating an account, clicking “I agree”, subscribing to a plan, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1. About the Service
auto4you is a business-to-business (B2B) Software-as-a-Service (SaaS) platform that provides AI voice agents which place and receive telephone calls on behalf of business Customers. Through a self-service dashboard, Customers configure and operate their own AI calling campaigns, including:
- Outbound calling — sales outreach, cold-calling, lead qualification, appointment booking, reminders, follow-ups and surveys;
- Inbound calling — automated answering, support and routing;
- AI voice agents that converse in Hindi, Hinglish and Indian regional languages;
- Campaign building, agent/script configuration, dialer and CRM integrations, call recording, transcription and analytics.
auto4you provides software tooling. You — the Customer — design, launch and control your own calling campaigns, and you are the calling party of record for every call placed or received through your account. auto4you does not, by itself, originate marketing communications to any recipient; it executes the campaigns, scripts, contact lists and instructions that you configure.
The Service is offered only to verified businesses and not to individual consumers for personal, household or private use.
2. Eligibility and Account Registration
To use the Service you must:
- be a business, firm, company or other legal entity (or an authorised representative acting on its behalf);
- be at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872;
- provide accurate, current and complete registration and KYC information (including, where required, business name, GST/PAN, address and authorised contact details); and
- where the Service is used for telemarketing or promotional calling, hold valid DLT (Distributed Ledger Technology) registration and the necessary telecom/regulatory registrations described in Section 5.
You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account, whether or not authorised by you. Notify us immediately at hardikagarwal@autosysai.dev of any unauthorised use or security breach. We may verify your identity and business details at any time and may suspend access pending verification.
3. Subscriptions, Credits and Billing
3.1 Pricing model
The Service is offered on a combination of (a) a recurring subscription plan and (b) usage-based credits consumed per minute or per call. Current plans, inclusions, the per-minute Credit rate, and prices are published on our Pricing page. Customers are billed in Indian Rupees (INR ₹) via PayU. auto4you is operated by a sole proprietor that is not currently registered under GST, so no GST is added to the published prices; if our GST status changes, applicable taxes will be shown at checkout before you pay. We do not levy hidden charges; the only amounts payable are the plan fee and any usage-based Credits you purchase, all as disclosed before you pay.
3.2 Credits
“Credits” are prepaid units of service usage that are consumed when AI calls are placed or received (for example, per minute of connected call time or per completed call). Credits:
- are prepaid, non-transferable and non-monetizable — they have no cash value, cannot be resold, exchanged, redeemed for money, or transferred to any other account or person;
- are consumed in real time as calls are made or received; and
- once consumed, are non-refundable, because the underlying telephony and AI service has already been rendered (see our Refund & Cancellation Policy).
3.3 Auto-renewal
Unless you cancel before the end of the current billing cycle, your subscription will automatically renew for successive periods of the same length, and your registered payment method will be charged the then-current plan fee. You authorise auto4you and its payment processor (PayU) to store your payment instrument and charge it on a recurring basis until you cancel. You may cancel auto-renewal at any time as described in Section 3.6 and in our Refund & Cancellation Policy.
3.4 Payment processors
Payments are collected through PayU, our PCI-DSS-compliant payment gateway in India. By providing payment details you also agree to the applicable terms of the payment processor. auto4you does not store complete card numbers or CVV data; card data is handled by the PCI-DSS-compliant processor.
3.5 Failed payments and price changes
If a payment fails or a charge is reversed, we may suspend or restrict your access and Credit balance until the amount due is settled. We may revise plan prices or the Credit consumption rate on prospective notice; changes take effect at your next renewal. Continued use after a price change constitutes acceptance.
3.6 Cancellation
You may cancel your subscription at any time from the account/billing area of app.auto4you.in or by emailing hardikagarwal@autosysai.dev. Cancellation stops future renewals; it takes effect at the end of the current paid period. Refund eligibility for unused subscription time and unused prepaid Credits is governed by our Refund & Cancellation Policy.
4. Acceptable Use Policy
This Acceptable Use Policy (“AUP”) is a material part of these Terms. You are solely responsible for the calls made and received through your account, for the contact lists you upload, and for the content of every script and message. Because the Service places and receives telephone calls, strict compliance is essential — and a breach of this Section is grounds for immediate suspension or termination.
4.1 You must
- act as the responsible sender / calling party of record for all calls originating from your account;
- complete and maintain valid DLT registration and use only registered, approved sender headers/IDs for promotional or transactional calling, as applicable;
- obtain, retain and be able to produce on request valid, demonstrable consent from each recipient before placing promotional, marketing or telemarketing calls, where consent is required by law;
- scrub your contact lists against, and fully honour, the National Customer Preference Register (NCPR) / Do-Not-Disturb (DND) registries and any opt-out requests;
- comply at all times with the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR / TRAI regulations), the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000, the Consumer Protection Act, 2019, and all other applicable telecom, data-protection, advertising and consumer-protection laws; and
- ensure you have a lawful basis and all rights necessary to upload, process and call the contacts in your lists.
4.2 You must not
- use the Service for any unlawful, fraudulent, deceptive, abusive or misleading purpose;
- place spam, unsolicited, or non-consented calls, or call numbers registered on DND/NCPR without a valid exemption or consent;
- impersonate any person, business, brand or government authority, or use false caller identity / spoofed numbers;
- run scripts that are harassing, threatening, defamatory, obscene, or that use high-pressure, get-rich-quick, guaranteed-returns, phishing, financial-scam or extortion tactics;
- promote content or conduct that is illegal in India, including illegal lending, illegal betting/gambling, prohibited financial schemes, counterfeit goods, or any restricted/prohibited category;
- attempt to bypass DND scrubbing, rate limits, usage metering, DLT requirements or any technical or contractual safeguard;
- reverse-engineer, scrape, resell, sublicense or build a competing service from the Platform, or exceed the access granted by your plan; or
- introduce malware, attempt unauthorised access, or interfere with the integrity, security or performance of the Service.
4.3 AI and call-recording disclosure
Calls placed or received through the Service may be AI-generated (a synthetic voice agent rather than a live human) and may be recorded and transcribed for quality, training, analytics and compliance. You are responsible for disclosing the AI and/or recorded nature of the call to recipients where such disclosure is required by applicable law, and for obtaining any consent that recording requires.
4.4 Enforcement
We may, with or without prior notice, investigate suspected violations, throttle or suspend campaigns, remove offending content, suspend or terminate your account, and report unlawful activity to telecom operators, regulators or law-enforcement authorities. We are not obliged to monitor your campaigns, but we may do so to protect the Platform, recipients and our regulatory standing.
5. Telecom and Regulatory Compliance
The Service is a tool used within India’s regulated telecom ecosystem. Compliance with TRAI, DLT, DND/NCPR and operator requirements is your responsibility as the principal entity making the calls. auto4you is a software and technology provider and is not the telemarketer, advertiser or principal entity behind your campaigns. You agree to indemnify auto4you (see Section 10) for any claim, penalty, complaint or regulatory action arising from your campaigns, your contact lists, your scripts, or your failure to hold the required registrations or consents.
6. Customer Data, Recordings and Data Protection
You retain ownership of the contact lists, lead data and campaign content you upload (“Customer Data”). With respect to Customer Data and the call recordings/transcripts generated from your campaigns, you act as the Data Fiduciary/Controller and auto4you acts as a Data Processor that processes such data on your documented instructions to provide the Service.
You represent and warrant that you have obtained all consents and have a valid lawful basis to upload, process and call the individuals in your Customer Data, and to have their calls recorded and transcribed. Our collection, use, retention and protection of personal data — including call recordings, transcripts and voice data — is described in our Privacy Policy, which forms part of these Terms. Sub-processors (including telephony/DLT providers, AI/LLM providers such as Google/Gemini, cloud hosting, and PayU) are identified in the Privacy Policy.
7. Intellectual Property
The Platform, including its software, dashboard, AI models and integrations, user interface, designs, text, graphics, logos and the “auto4you” name and marks, are the exclusive property of auto4you and/or its licensors and are protected by Indian and international intellectual-property laws. Subject to these Terms and timely payment, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during your subscription. No other rights are granted. You retain all rights in your Customer Data and the call content you create; you grant us a licence to host, process and transmit that data solely to operate and improve the Service and to comply with law.
8. Service Availability and No Outcome Guarantee
We aim to keep the Service available and reliable but do not warrant uninterrupted, timely, secure or error-free operation. The Service depends on third-party telecom networks, carriers, AI providers and cloud infrastructure that are outside our control, and call connectivity, voice quality, latency and deliverability may vary. auto4you does not guarantee any specific business result — including any number of leads, conversions, appointments, sales, answer rates or return on investment. Any uptime commitment, if offered, will be stated in a separate written Service Level Agreement (SLA) agreed with you; in the absence of such a written SLA, the Service is provided on an “as-available” basis.
9. Disclaimers and Limitation of Liability
9.1 “As is”. To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
9.2 Limitation. To the maximum extent permitted by applicable law, auto4you and its directors, employees, affiliates and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, or for any regulatory fines or third-party claims arising from your campaigns. Our total aggregate liability arising out of or relating to the Service shall not exceed the total fees actually paid by you to auto4you in the three (3) months immediately preceding the event giving rise to the claim.
9.3 Customer responsibility. auto4you is not responsible for the content, legality or consequences of the calls, scripts, contact lists or messages you choose to deploy.
Nothing in these Terms excludes any liability that cannot be excluded under applicable law.
10. Indemnification
You agree to defend, indemnify and hold harmless auto4you, its affiliates, officers, directors, employees and agents from and against any and all claims, demands, losses, liabilities, damages, penalties, fines, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your campaigns, scripts, Customer Data or contact lists; (c) your breach of this AUP, of these Terms, or of any applicable telecom, data-protection, consumer or other law; (d) any consent, DLT, DND/NCPR or recording-disclosure failure; or (e) any third-party claim or regulatory action arising from calls made or received through your account.
11. Suspension and Termination
We may suspend or terminate your access, in whole or in part, immediately and without liability, if: (a) you breach these Terms or the AUP; (b) we are required to do so by a telecom operator, regulator, payment processor or law; (c) your account is used for fraud, spam or unlawful activity; (d) payment is overdue or reversed; or (e) continued provision would expose auto4you to legal, regulatory or reputational risk. You may stop using the Service and cancel at any time per Section 3.6. On termination, your right to use the Service ends, unconsumed Credits are handled under the Refund & Cancellation Policy, and Sections that by their nature survive (including Sections 6, 7, 9, 10, 12 and 13) continue to apply.
12. Governing Law, Jurisdiction and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to the dispute-resolution process below, the courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction.
The parties shall first attempt to resolve any dispute amicably through good-faith discussions. Any dispute not so resolved shall be referred to and finally settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by auto4you, with the seat and venue at Jaipur, Rajasthan, India, and proceedings conducted in English.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, law or business practices. The “Last updated” date above indicates the latest revision. Material changes will be notified by email or through the Platform. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, Refund & Cancellation Policy and Pricing, constitute the entire agreement between you and auto4you regarding the Service.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including telecom outages, carrier failures, internet disruptions, acts of government, or natural events.
